Humboldt Fence Rules When the City Sits in Two Counties

Written by Greg
Owner, Fence Company Jackson TN — Jackson, TN

Humboldt straddles the Gibson and Madison county line. Here is what the city code says, what it does not, and which phone to pick up.

Who issues fence permits in Humboldt, TN? That depends on the parcel, and nobody I could find has published a clear answer. Humboldt sits in Gibson and Madison counties, most of it in Gibson. Start with Humboldt city hall, then the Gibson or Madison County building office, and get the answer for your address in writing.

Humboldt lies in two counties. Most of the city is in Gibson County, and a small portion extends into Madison County, the same county as Jackson. If you own a house there and want a fence, the first question is not how tall. It is which office you call.

I read the Humboldt municipal code for this guide. It has a few real fence-related rules, which I will lay out. It also leaves some questions open, and I will say which ones. I would rather tell you that than guess and have you pay for it later. Humboldt is on the fence installation map and has its own repair page.

Step One: Figure Out Which Side You Are On

Humboldt's published code does not tell a homeowner which county office handles a Madison-side parcel. I could not find a county map that answers it for an individual address either. So the first step is to confirm where your parcel is. Your property tax bill, your deed, or a call to the county assessor can tell you which county your lot is in.

From there, here is what is published about each office.

One question settles most of it: "I own a lot at this address, I am planning a fence of this height and style, and I need to know whether the city, the county, or both require a permit." Ask it of city hall first, and ask for the answer in writing, an email is fine.

What the Humboldt Code Says About Fences

Here the Humboldt Municipal Code does speak, in a few places.

Yards. The code's definition of a yard allows fences, walls, poles, posts and other customary yard accessories in any yard, subject to height limitations and requirements limiting obstruction of visibility. That tells you fences are allowed. It does not give a general residential height cap, and I looked for one. The code as I read it has no general residential fence height maximum and no finished-side-out rule.

Corner lots. Section 14-211 keeps a clear vision zone. On a corner lot outside the central business district, within the area formed by the street center lines and a line joining points one hundred feet from where they meet, nothing may block vision between two and a half and ten feet above the street. It does not prohibit a necessary retaining wall. The corner lot sight triangle guide compares this to Jackson, the county and Lexington.

Pool enclosures. The pool rules in Title 12, Chapter 8 are specific, and they are Humboldt's own figures. An outdoor pool or family pool must be completely surrounded by a fence or wall at least five feet high, with no openings, holes or gaps larger than four inches except for doors and gates. Gates must be self-closing and self-latching, with the latch at least four and a half feet above the ground or otherwise out of reach of small children. A house or accessory building can form part of the enclosure. The rule covers new outdoor pools and any existing pool with at least eighteen inches of water. No enclosure may be built without first getting a permit from the building inspector.

If you are thinking about a pool fence, read the pool fence requirements guide too, and check pool fencing services. The code also lets the building inspector modify the height, nature or location of the fence, gates or latches in individual cases, as long as protection for small children is not reduced. Do not carry another town's pool numbers into Humboldt.

Junkyards and storage. The code says a junkyard must be enclosed in a close-fitting plank or metal solid fence that touches the ground and is at least six feet high. That is for a junkyard, not a backyard. If you have a commercial yard question, see commercial fencing and call city hall.

The Building Code Edition Question

Humboldt's published combined code lists the 2006 edition of the International Residential Code and Building Code. That is old, and it may have been replaced by an amendment that is not in the version I read. I am telling you this because the edition changes what an inspector looks at for a taller or structural fence. Ask city hall which edition is in force before anyone relies on a number.

For comparison, Madison County's published construction guide lists the 2018 editions, and Lexington's building department lists 2024. Do not assume the same edition applies everywhere in West Tennessee.

What I Could Not Find

I would rather leave these blank than give you a number off some other website. When I give you a rule on this page, it comes from the code or a county page I read. Everything else is a question with a phone number next to it. For shared lines, also read the property line guide, because the city does not settle where your boundary is.

Where This Leaves a Fence in Humboldt

  1. Confirm the county. Tax bill, deed, or assessor.
  2. Call city hall. Ask whether a fence permit is required and who issues it.
  3. Ask the county office that matches your parcel. Gibson at (731) 855-7663 or Madison at (731) 423-6014.
  4. Ask for the building code edition if the fence is tall or structural.
  5. Check the corner. If you are on a corner lot outside the B-3 central business district, use the hundred-foot center-line rule.
  6. Call 811. The state requires it before any digging, and the 811 guide explains the timing.

Once the paperwork picture is clear, the actual build is the easy part. See Gibson County fence installation and Madison County fence installation for what we do on each side.

Common Questions About Humboldt Fence Rules

Is Humboldt in Gibson County or Madison County?

+

Both. The city spans the line, and most of it is in Gibson County. Your own lot may be on either side, so check your tax bill or deed before you call an office.

How tall can a fence be in Humboldt?

+

The city code as I read it has no general residential fence height cap. It allows fences in yards subject to height limitations and visibility rules, and it keeps corner lots clear between two and a half and ten feet. Ask city hall about your specific lot.

What fence does a pool need in Humboldt?

+

At least five feet high, with no openings larger than four inches, and self-closing, self-latching gates with the latch at least four and a half feet up or otherwise out of small children's reach. A permit from the building inspector is required before construction.

Do I need a county permit for a fence inside Humboldt?

+

I cannot say for your address. Madison County's residential permit exemption list includes fences not exceeding seven feet, but whether its office handles a lot inside Humboldt is not published. Gibson County's page does not say whether it covers incorporated cities. Call city hall first.

Does Humboldt require the finished side to face out?

+

Not in the code I read. Jackson has that rule and Humboldt does not appear to. As general practice, a board-on-board or shadowbox style looks finished from both sides, which keeps the neighbor conversation easy.

The Honest Bottom Line

Humboldt gives you a few firm rules and one big open question. The rules are the corner vision zone, the yard definition and the pool enclosure. The question is who handles your permit. Settle it with two phone calls before anyone orders lumber or vinyl.
